Finally, after the court is satisfied that all legal requirements have been met, it will order all debts, claims, taxes, attorney”s fees and the personal representative ‘s compensation and any other miscelaneous expenses to be paid.
If there is not enough cash in the estate to pay these substantial claims, the judge can order that assets be sold at public auctions or estate sales.
These transactions are often conducted in a depressed market or under the heading of “distressed sales “.
Only after all the bills are paid will the probate court distribute the estate to the beneficiaries named in the Will: or if there is no Will, to the designated heirs at law.
The court then closes the file !

……..was the question asked by the court appointed Executor , following my husband’s untimely death on the job.
We had a Will, drafted about three years after our marriage and before we had any children, Now, with children of 10 and 12 years old , we had not up-dated our Will, and I had no idea where our Will and many of our private papers were located. !!

One of my famed country and western singers, Willie Nelson, sings a great country song titled “ Angels Flying Too Close To The Ground “, and it reminded me of how some people contineously flirt with death’s timetable before they are hurriedly forced to draw up a WILL ?
For whatever reason, it seems to take the on-set of an unexpected incident to compel them to draft a Will.
However, being in that position does not provide a condusive atmosphere to be able to think clearly about the details one might otherwise want to include in their Will.
We know of no husband that would deliberately want to put their family’s future in turmoil, yet, all to frequently, that happens because little time was spent by the parent’s to take the proper time to draft a well thought out Will. Since there are no short-cuts to do this job properly, take the time that will make a difference in your family’s future.
